Please read these Terms carefully before using IEPvocate. By using our service, creating an account, or making a payment, you agree to be bound by these Terms. If you do not agree, please do not use IEPvocate.

1. Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you and IEPvocate ("IEPvocate," "we," "us," or "our"), operated by Paul and Julia Scalia, based in New Jersey. These Terms govern your access to and use of the IEPvocate website at iepvocate.com (the "Service").

By using the Service, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and are the parent or legal guardian of the child whose IEP documents you upload.

2. What IEPvocate Is

IEPvocate is an AI-powered educational information tool designed to help parents and guardians of children with disabilities understand IEP (Individualized Education Program) documents, generate questions for IEP meetings, and draft communications to share with their child's school team.

IEPvocate offers a free tier (AI-generated resource guide from your uploaded IEP) and paid subscription tiers (monthly and annual) that unlock additional features including meeting prep questions, advocacy letters, communication templates, and an AI chat assistant.

IEPvocate is not a law firm. IEPvocate does not provide legal advice.

All content generated by IEPvocate — including resource guides, meeting questions, advocacy letters, communication templates, modification recommendations, and AI chat responses — is educational information only. It is not a substitute for advice from a licensed special education attorney, a certified special education advocate, or other qualified professional.

For serious disputes — including rejected IEPs, due process hearings, mediation, or complaints to the state education agency — you should consult a licensed special education attorney or contact your state's Parent Training and Information (PTI) center.

References to IDEA (the Individuals with Disabilities Education Act) or other laws in AI-generated content are provided as general educational information about parent rights, not as legal counsel specific to your situation. Laws and regulations vary by state and may change. Always verify current requirements with a qualified professional. 4. Your Account and Subscriptions

4.1 Account creation

Paid plans (monthly and annual) require an email address to create an account. You access your account via a magic link (a one-time sign-in link sent to your email) — no password is required. You are responsible for keeping your email address current and for the security of your email account.

4.2 Subscription billing

Paid subscriptions are billed through Stripe, our payment processor. By subscribing, you authorize IEPvocate to charge your payment method on a recurring basis (monthly or annually, as chosen) until you cancel. Prices are displayed at the time of purchase and may change with advance notice.

4.3 Single-report purchase

The Single Report option is a one-time payment that does not create a persistent account. Your analysis results are available only during the active browser session; they will be lost when you close the browser. Save any outputs you want to keep before closing the page.

4.4 Cancellation

You may cancel your subscription at any time through the Stripe Customer Portal, accessible from within your IEPvocate account. Cancellation takes effect at the end of the current billing period. We do not provide partial refunds for unused time within a billing period. After cancellation, your account data will be retained for 90 days and then deleted.

4.5 Refunds

We offer refunds on a case-by-case basis. If you have a problem with the Service, please contact us at hello@iepvocate.com and we will work with you to resolve it.

4.6 Monthly AI generation quota

Paid subscription plans include up to 30 AI-generated outputs per calendar month. Quotas reset on the first of each month. The quota applies across all premium features (questions, advocacy letters, templates, modifications, and chat messages). Lifetime plan holders (legacy accounts only — lifetime is no longer sold) are exempt from quotas.

You retain all rights to the IEP documents you upload. By uploading a document, you grant IEPvocate a limited, temporary license to process that document solely to provide the Service to you. This license ends immediately when processing is complete. We do not claim any ownership of your child's educational records.

As described in our Privacy Policy, IEP documents are processed in real time and never stored by IEPvocate. Document content is transmitted to Anthropic's AI API for processing and is subject to Anthropic's data handling policies.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

IEPvocate does not warrant that: (a) the Service will meet your specific requirements; (b) AI-generated content will be accurate, complete, or appropriate for your situation; (c) the Service will be uninterrupted, error-free, or free of harmful components; (d) any AI-generated advocacy letter, template, or recommendation will achieve any particular result in dealings with your child's school.

AI-generated content may contain errors, omissions, or outdated information. Always review AI-generated materials critically before using them.

8. Limitation of Liability

To the maximum extent permitted by applicable law, IEPvocate and its founders, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid to IEPvocate in the 12 months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless IEPvocate, its founders, and affiliates from any claims, losses, or damages (including reasonable attorneys' fees) arising from: (a) your use of the Service in violation of these Terms; (b) content you submit that infringes third-party rights; or (c) your violation of any applicable law.

10. Third-Party Services

IEPvocate integrates with third-party services (Anthropic, Stripe, Supabase, Resend, Vercel). We are not responsible for the practices, content, or availability of these third-party services. Your use of these services is subject to their own terms and privacy policies.

11. Intellectual Property

IEPvocate, its logo, branding, AI prompt designs, and all original website content are owned by IEPvocate and protected by copyright and other intellectual property laws. You may not copy, reproduce, or distribute IEPvocate's proprietary content without written permission.

AI-generated outputs (resource guides, letters, templates, questions) produced for you are licensed to you for personal use in advocating for your child's education. You may not resell or commercially distribute AI-generated outputs created by IEPvocate.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.

Before initiating any legal action, we encourage you to contact us at hello@iepvocate.com so we can try to resolve the issue informally.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. If the changes are significant, we will provide notice via the Service or by email. Your continued use of IEPvocate after updated Terms are posted constitutes your acceptance of the changes.

14. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in conduct that we determine is harmful to other users, to us, or to third parties. You may stop using the Service at any time by cancelling your subscription and ceasing use.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and IEPvocate regarding the Service and supersede any prior agreements or understandings.
